Title: Workplace Heat Protections

What Does it Mean: known as the Workplace Heat Protection Standards Act, requires the Department of Labor and Industry (and its secretary) to adopt regulations within one year that mandate employers implement protections for workers against heat-related injuries and illnesses triggered by heat stress.

Key provisions include

  • requiring employers to monitor heat index levels (with standards triggered at around 80°F), provide adequate water, paid rest breaks, access to shade or cooling, develop written heat illness prevention plans that cover acclimatization for new or returning workers, symptom recognition, emergency responses, and training for employees and supervisors.
  • prohibit retaliation against workers who report issues or seek care.
  • establishes the Heat Protection Enforcement Fund and imposes penalties for violations aiming to safeguard workers—regardless of sector—from extreme heat risks amid climate change.
