The Bill: SB908 (Senator Farry) R
Title: Protecting Pennsylvanian Workers
What Does it Mean: this bill amends the state’s prevailing wage law in two major
ways.
1) it expands prevailing wage requirements to cover certain off-site “custom
fabrication” work performed specifically for public construction projects, meaning
workers making custom-built components for public projects would generally have to
be paid the same prevailing wage rates that apply at the project site.
2) it creates exemptions from prevailing wage requirements for the rehabilitation of
certain residential properties (fewer than eight residential units) and for qualifying
school safety and security improvement projects costing $50,000 or less.
And) makes custom fabrication contractors subject to the same reporting,
compliance, enforcement, and penalty provisions that apply to other public works
contractors.

1) Small fabrication shops that manufacture custom components for public projects
could face higher labor costs if they currently pay below prevailing wage rates.
2) businesses would also have new recordkeeping, reporting, payroll, and
compliance obligations because the bill explicitly applies prevailing wage
enforcement requirements to custom fabrication contractors.
3) Small contractors that rely on lower-cost custom fabrication suppliers may see
higher bid costs on public projects.
