Corporate Transparency Act: A letter to President Trump

Dear President Trump,
We are writing to express our sincere gratitude and congratulations on being our President of the United
States. As small business owners and leaders of the Go Big Small Biz Network here in Pennsylvania, we
want to thank you for your steadfast commitment to standing up for our country and our rights, no
matter the cost.
As part of a network that represents thousands of small businesses across our state, we are deeply
concerned about the implementation of the Corporate Transparency Act (CTA), a federal law enacted as
of January 1, 2024. The CTA requires small businesses-those with fewer than 20 employees and less
than $5 million in annual revenue- to submit Beneficial Ownership Information (801) to the Financial
Crimes Enforcement Network (FINCEN).
We believe this law is a direct violation of the Fourth and Fourteenth Amendments of the U.S.
Constitution. Specifically, the law allows the government to access the private personal information of
small business owners without the need for a warrant or subpoena, undermining the protections
afforded by the Constitution. We believe that the very purpose of our Constitution is to safeguard
citizens from unjust and unlawful government overreach.
As small business owners of three businesses, including the Go Big Small Biz Network, we strongly urge
you to take action to repeal this law within your first 100 days in office. When the CTA was first
introduced in Congress in 2019, it was during your administration. While you vetoed the law at that time,
it was ultimately pushed through by your Treasury Secretary, Mr. Steven Mnuchin, and later became law
under the National Defense Authorization Act for Fiscal Year 2021 during the Biden administration.
This law, which affects over 32 million small businesses nationwide, has the potential to impose severe
financial penalties and criminal charges on business owners who fail to comply. Small business owners,
many of whom are unaware of the law’s existence, are facing up to $10,000 in fines and two years in
prison per business for non-compliance. For example, in our case, with three small businesses, this could
result in $30,000 in fines and six years in prison for a law we firmly believe to be unconstitutional.
We are not alone in our opposition to this law. There is currently a proposed repeal in Congress,
sponsored by Representative Warren Davidson of Ohio and co-sponsored by 83 other members of
Congress. As leaders of the Go Big Small Biz Network and on behalf of thousands of small business
owners across Pennsylvania and the United States, we respectfully ask for the opportunity to meet with
you to discuss the negative impact t his law will have on small businesses and the economy. We are ready.
