Upgrading the Malt Beverage Tax Credit Program

The following bill passed the House 194-7 on May 5, 2026.

The Bill: HB2340 Rep Ana Tubercio

Title: Upgrading the Malt Beverage Tax Credit Program

What Does it Mean: The malt beverage tax credit, reauthorized in Pennsylvania in 2016, allows breweries to claim a tax credit for capital investments in their facilities or equipment, up to a maximum of $200,000. (The bigger breweries benefit) However, because the credit is non-refundable, cannot be sold or transferred, and can only be carried forward for three years, many smaller breweries—especially new ones that often incur $200,000 or more in startup costs—are unable to fully utilize it when they need financial relief the most

The Go Big Small Biz Network’s Position: Agree with Rep Griener, who, what, when and how do we give tax credits? Once we give to one industry are we compelled to give to another. How do you make up tax revenue?

Quotes from Rep Griener:

“Helping big business”

“Big guys get the benefit”

“Tax credits are a slippery slope”

“We need an extensive look at all tax credit programs” “I will vote for it because it already exist”
