What Does it Mean: 
Implications for Small Businesses

  • Small businesses with 4+ employees would face expanded rules against discrimination. This includes hiring, firing, promotions, workplace policies, customer service, and advertising. Violations could lead to complaints filed with the Pennsylvania Human Relations Commission investigations, hearings, potential fines and lawsuits.
  • Republicans argue it could raise litigation risks for small businesses, faith-based organizations, or those with religious objections—e.g., around bathrooms/locker rooms, women’s sports, or service refusals based on sincerely held beliefs. Democrats say it simply ensures equal treatment and that existing religious exemptions remain. Businesses may need updated policies, training, or legal reviews.

If passed by the Senate and signed by the Governor, it would take effect 60 days later. Many details (enforcement, exemptions) would be shaped by Pennsylvania Human Relations Commission regulations and court interpretations.
